01Why this holds
In Russia and Belarus, documented political prisoners are overwhelmingly prosecuted for what they published — a post, a repost, a broadcast. Kazakhstan is the mirror image. Where our records capture what the case actually rests on, it is far more often physical presence — turning up at a protest, standing in a square — than anything said online. The vehicles are broad public-order and “discord” charges (Articles 174 and 272), and they carry long sentences: a documented median of 6 years. It is a repression aimed less at silencing speech than at clearing the street.

03How to read this honestly
- §These are cases documented in our database — drawn from the Open Dialogue Foundation, the Kazakhstan International Bureau for Human Rights (bureau.kz), Radio Azattyq and International Partnership for Human Rights — not a count of every prosecution. The value here is a case-level record of what each person was accused of doing, with a source.
- §A basis is recorded for 103 of 159 cases; the rest are marked Unknown and shown as such in the chart. The "59% physical presence" and "22% online speech" figures are of the 103 documented-basis cases.
- §"Physical presence" means the prosecution's case rests on the person being present — typically at a protest — not on any proof they committed violence. It is an editorial classification drawn from the cited evidence, and each case carries a confidence score.
- §Sentences are recorded for 66 cases; the median (6) and maximum (18) are computed over those. People still in pre-trial detention or awaiting sentence are excluded from the sentence figures.
